OVERVIEW Welcome to ShopMixMax! These terms refer to ShopMixMax, operating out of Finland. By using our Services, you agree to these Terms of Service and our Privacy Policy.

SECTION 1 - ACCESS AND ACCOUNT You represent that you are of the age of majority and have authority to use our Services. You are responsible for maintaining the security of your account credentials. We may restrict or suspend access to accounts that demonstrate patterns inconsistent with these Terms or that may pose a risk to the security of our platform.

SECTION 2 - OUR PRODUCTS Product representations are provided in good faith. We may adjust inventory or discontinue items at our discretion to manage service quality.

SECTION 3 - ORDERS, FRAUD PROTECTION & RETURNS Orders constitute an offer to purchase. We may decline orders where verification protocols (such as 3DS, AVS, or CVV checks) do not meet safety standards or where inventory is unavailable.

  • 3DS Policy: Transactions authenticated via 3DS (3D Secure) are processed in accordance with industry security standards and card scheme rules regarding liability allocation.

Return Summary & Conditions:

  • Withdrawal: EU customers have a 14-day statutory right to withdraw without reason.

  • Refund Policy: Refunds are processed after items are returned and inspected. We may apply adjustments to the refund value for any diminution in the item's condition resulting from handling beyond what is necessary to establish the nature and functioning of the goods.

SECTION 4 - PRICES, BILLING, AND TAXES Prices are as displayed at checkout. Customers are responsible for any applicable import VAT or customs duties outside the EU.

SECTION 5 - SHIPPING AND DELIVERY

  • Processing: 1–3 business days. Delivery: 7–17 business days.

  • Proof of Fulfillment: Delivery times are estimates. Under EU law, if an order is not delivered within 30 days, you may cancel for a full refund. In the event of a payment dispute, we provide documentation to the payment processor, including tracking data, delivery confirmation, and order correspondence, to support the validation of the fulfillment.

SECTION 6 - INTELLECTUAL PROPERTY All content is owned by ShopMixMax and is for personal, non-commercial use only.

SECTION 7 - OPTIONAL TOOLS & THIRD-PARTY LINKS We provide access to third-party tools and links "as is" and are not responsible for third-party practices.

SECTION 8 - RELATIONSHIP WITH SHOPIFY Shopify hosts our store, but sales are made directly with ShopMixMax.

SECTION 9 - PRIVACY POLICY & GDPR Information is processed per our Privacy Policy.

  • Legal Basis: We process data under GDPR Art. 6(1)(b) (contract) and 6(1)(f) (legitimate interest).

  • Data Rights: You may request access, correction, or deletion of your data at any time via info@shopmixmax.com.

  • Retention: Transactional data is kept for up to 7 years to comply with tax/accounting obligations. Fraud-related logs (IP/device identifiers) are kept for 24 months for security and dispute support purposes.

  • Breach Notification: We will notify authorities and affected users within 72 hours of a breach, where required by law.

SECTION 10 - FEEDBACK Feedback submitted is licensed to us for use without compensation.

SECTION 11 - ERRORS AND INACCURACIES We reserve the right to correct information or cancel orders due to errors at any time.

SECTION 12 - PROHIBITED USES Prohibited uses include unlawful activity, harassment, viruses, or attempts to circumvent our security measures.

SECTION 13 - AGENTS Agents must identify themselves and comply with these Terms.

SECTION 14 - TERMINATION We may restrict, suspend, or terminate access to the Services where necessary for fraud prevention, abuse prevention, misuse, or to ensure compliance with legal obligations.

SECTION 15 - DISCLAIMER & LIMITATION OF LIABILITY Services are provided "as is". To the maximum extent permitted by law, ShopMixMax shall not be liable for any indirect or consequential damages. This does not exclude mandatory consumer protections.

SECTION 16 - INDEMNIFICATION You agree to indemnify us against claims arising from your breach of these Terms or violation of law.

SECTION 17 - GOVERNING LAW & DISPUTE RESOLUTION These Terms are governed by Finnish law. Disputes may be addressed via our support channels, without prejudice to the customer's right to use the EU ODR platform: http://ec.europa.eu/consumers/odr/ or to seek resolution in their local jurisdiction. SECTION 18 - CHANGES TO TERMS We may update these Terms by posting changes to our website. Continued use constitutes acceptance.
